What is HDS health data hosting?
HDS health data hosting refers to the hosting of personal health data collected in the context of prevention, diagnosis, care, or social and medico-social follow-up. It may be performed on behalf of a data controller or on behalf of the patient. For digital hosting, the hosting provider must hold an HDS certificate of conformity. This certification is designed to frame the hosting of health data under security conditions adapted to the sensitivity of this data.
Who needs an HDS-certified health data hosting provider?
Any data controller that entrusts a third party with the hosting of personal health data must ensure that this third party holds an HDS certificate of conformity. This may apply to healthcare facilities, healthcare software vendors, laboratories, insurers, mutual insurance providers or digital service providers when their service falls within the scope of HDS hosting. The assessment must be made case by case, depending on the data processed, each party’s role and the outsourced services.
Does using Clever Cloud make my organisation HDS-certified?
No. HDS certification is held by the certified hosting provider, for a defined certification scope. By using Clever Cloud under a dedicated HDS contract, your organisation benefits from HDS-certified hosting for the scope covered by Clever Cloud’s certification and the associated contract. The HDS certification is not transferred to your organisation and does not automatically cover all of your regulatory, application-level or GDPR obligations.
Is a specific HDS contract required?
Yes. Personal health data hosting must be covered by a contract between the hosting provider and its customer. This contract must specify, among other elements, the scope of the HDS certificate held by the hosting provider, the services provided, hosting locations, service levels, access conditions, guarantees in case of provider failure, reversibility conditions, and commitments regarding the return and deletion of data at the end of the service.
